4) Legal Implications: The True Cost of Hate Crimes
The severity of such crimes may involve consultation with the Crown if it is believed the crime was committed based on bias, prejudice, or hate. Hate’s involvement as an aggravating factor may be taken into account by the jude when imposing a sentence if an individual is charged and convicted. Cases that involve the wilful promotion of hatred and the advocation of genocide—categorized as hate speech offenses—necessitate the Attorney General’s consent to lay charges. Placing these charges often occurs at a later stage.
